GENERAL TERMS AND CONDITIONS OF SALE - GITE DU COLOMBIER VERT

Article 1: Purpose

These general terms and conditions of sale concern the seasonal rental of the cottage named ""Nid douillet au Colombier vert"" and La Suite du Colombier vert""

These terms and conditions define the rights and obligations of the parties in the context of remote booking of services offered by our establishment, whose contact details are specified in the booking confirmation document. They govern all the steps necessary for booking and managing the booking between the contracting parties. The client acknowledges having read and accepted these general terms and conditions of sale and the terms and conditions of sale for the reserved rate, accessible on our booking platform. These general terms and conditions of sale apply to all bookings made online, via our booking platform.

Article 2 – Length of stay

The signing client concludes a reservation for a fixed period and may not under any circumstances claim any right to remain on the premises after the end of the stay.

Article 3 – Responsibility

The company Révé, trading as Le Colombier Vert, which manages the furnished tourist accommodation, has entrusted La Conciergerie de l'Yonne with the management of its seasonal rentals. La Conciergerie de l'Yonne is therefore the sole point of contact for the signing client and is responsible to them for fulfilling the obligations arising from these terms and conditions of sale. La Conciergerie de l'Yonne cannot be held responsible for unforeseen events, force majeure or the actions of any person outside the organization and execution of the stay.

The photographs displayed on our booking platform are not contractual. While every effort is made to ensure that the photographs, graphic representations, and texts used to illustrate the establishment provide as accurate a representation as possible of the services offered, variations may occur between the time of booking and the day the service is used. The establishment cannot be held liable for the non-execution or improper execution of the booking in cases of force majeure, actions of third parties, or actions of the client, including but not limited to internet network unavailability, inability to access the website, external intrusion, computer viruses, or in the event of unauthorized prepayment by the cardholder's bank. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the latter.

The customer accepts and agrees to abide by the House Rules and the clauses detailed below. If the customer fails to comply with any provision of the House Rules, Le Colombier Vert will be obliged to ask the customer to leave the premises without any compensation or refund, even if payment has already been made.

Article 4 – Booking and Confirmation

The reservation becomes firm when Le Colombier Vert receives the deposit corresponding to 25% of the rental amount plus all additional fees. In case of late booking, the full amount of the reservation is required.

Upon receipt of payment for the stay, the Conciergerie de l'Yonne will send a confirmation email to the client.

The customer selects the services presented on our booking platform. They acknowledge having reviewed the nature, purpose, and booking terms of the services available on our platform and having requested and obtained all necessary and/or additional information to make their booking with full knowledge of the facts. The customer is solely responsible for their choice of services and their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the customer upon completion of the booking process.

Reservations made by the customer are processed via the electronic booking form accessible online on our booking platform. The reservation is considered confirmed upon receipt of the booking form.

Before making any reservation, the customer agrees to complete all required information on the booking form or request. The customer confirms the truthfulness and accuracy of the information provided. After the final selection of services to be booked, the booking process includes, in particular, entering credit card details if a guarantee or prepayment is required, reviewing and accepting the general terms and conditions of sale and the specific terms and conditions of the chosen rate before confirming the reservation, and finally, the customer's confirmation of the reservation.

Our booking platform acknowledges receipt of the customer's booking by sending an email without delay. In the case of online booking, the booking confirmation email summarizes the contract offer, the services booked, the prices, the terms and conditions of sale relating to the selected rate, accepted by the customer, the date of booking made, information relating to after-sales service, as well as the address of the seller's establishment to which the customer can submit their complaints.

Article 5 – No right of withdrawal

Customers are reminded that for reservations made by mail, telephone or internet, the customer does not benefit from the withdrawal period, in accordance with Article L121-20-4 of the Consumer Code relating to accommodation services provided on a specific date.

The terms and conditions of sale for the reserved rate specify the terms and conditions for cancellation and/or modification of the reservation. When the terms and conditions of the reserved rate allow, the reservation can be cancelled directly with Le Colombier Vert.

All reservations are nominative and cannot under any circumstances be transferred to a third party, whether free of charge or for payment.

Article 6 - Price

The prices for booking services are displayed before and during the booking process. Prices are confirmed to the customer inclusive of all taxes, in the establishment's local currency, and are valid only for the period indicated on the booking platform. If payment is made at the establishment in a currency other than the one confirmed on the booking, the customer is responsible for any exchange fees. All bookings, regardless of origin, are payable in the establishment's local currency, unless otherwise specified on-site.

Unless otherwise stated on the booking platform, additional services are not included in the price. Any applicable taxes (local taxes, tourist taxes, etc.) shown on the rates page must be paid directly to the establishment.

Prices include VAT applicable on the date of the order, and any change in the applicable VAT rate will be automatically reflected in the prices shown on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will also be automatically reflected in the prices shown on the invoice date.

Article 7 - Payments

The reservation becomes firm when Le Colombier Vert receives the deposit corresponding to 25% of the rental amount plus all additional costs. In case of late booking, the full amount of the booking is required.

In the case of a rate subject to online prepayment, the sum paid in advance, referred to as a deposit, is debited at the time of booking.

Settlement of the balance:

The client must pay Le Colombier Vert the remaining balance for the agreed-upon service one month before the start of their stay. If the client has not paid the balance by the agreed date, their stay will be considered cancelled. The service will then be made available for booking again, and no refund will be issued.

Late booking:

For bookings made less than 30 days before the start of the stay, full payment will be required at the time of booking.

The green dovecote can send an invoice electronically upon request.

The customer provides their bank details as a guarantee of the reservation, except for special conditions or rates, by credit or private bank card (Visa, Mastercard, American Express, Diners Club… depending on the possibilities offered by the establishment's booking platform) by directly indicating, in the area provided for this purpose (secure entry by SSL encryption), the card number, without spaces between the digits, as well as its expiry date (it is specified that the bank card used must be valid at the time of consumption of the service) and the visual cryptogram.

He must present himself at the establishment with the bank card that allowed him to guarantee the reservation.

In the event of a no-show (reservation not cancelled – customer not present) for a reservation guaranteed by credit card, the establishment will debit the customer, as a fixed compensation, for the amount indicated in its general terms and conditions and specific terms of sale.

The establishment has chosen elloha.com/stripe.com to secure online credit card payments. The validity of the customer's payment card is verified by stripe.com. A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of a problem, the customer should contact their bank and the establishment to confirm their reservation and payment method.

Article 8 - Evidence Convention

Entering the required bank details, along with accepting these terms and conditions and the booking confirmation or request, constitutes an electronic signature which, between the parties, has the same legal value as a handwritten signature. The computerized records stored in elloha.com's computer systems will be kept under reasonable security conditions and considered proof of communications, orders, and payments between the parties. The customer is informed that their IP address is recorded at the time of booking.

Article 9 – Arrival

The Yonne Concierge Service will contact the client no later than one week before the start of their stay to arrange an arrival time. In case of a delayed arrival or last-minute cancellation, the client must inform the Yonne Concierge Service by phone or text message.

Article 10 – Cancellation by the customer

Any cancellation must be notified by email, with confirmation of receipt, to the Conciergerie de l'Yonne.

For any cancellation made by the customer, the refund from Le Colombier vert will be processed as follows:

  • Cancellation 48 hours after booking: the stay is fully refunded less bank charges if payment was made by credit card (3%).

  • Cancellation up to and including 30 days before the start of the stay: refund of the stay less bank charges if payment was made by credit card (3%).

  • Cancellation between 29 and 8 days before the start of the stay: 50% refund of the stay minus bank charges if payment was made by credit card (3%).

  • Cancellation between the 7th day and the scheduled arrival day or no-show: no refund will be issued.

Article 11 – Modification of a substantial element

If, before the scheduled start date of the stay, Colombier vert is forced to make a change to one of the essential elements of the contract, the client may, after being informed by the Conciergerie de l'Yonne by email, with confirmation of receipt, either cancel the contract and obtain without penalty an immediate refund of the sums paid, or accept the modification.

Article 12 – Cancellation by the seller:

If Le Colombier Vert cancels the stay before its commencement, the Conciergerie de l'Yonne must inform the client by email with confirmation of receipt. The client will be reimbursed immediately and without penalty for all sums paid. These provisions do not apply if an amicable agreement is reached whereby the client accepts a substitute stay offered by the seller.

Article 13 – seller's impediment:

If during the stay, Colombier vert is unable to provide a substantial part of the services provided for in the contract representing a significant percentage of the price paid by the client, it will pay the client compensation corresponding to the pro rata amount of the unused rental.

Article 14 – Interruption of stay:

In the event of an interruption of stay by the client, no refund will be issued.

Article 15 – Accommodation capacity:

This reservation is for a maximum of three people. If the number of guests exceeds the maximum capacity, the Conciergerie de l'Yonne will refuse entry to the additional guests. Any modification or cancellation of the contract will then be considered to be at the client's initiative.

Parties are prohibited both inside and outside the cottage.

Article 16 – Assignment of the contract by the client:

The client may not transfer their reservation to a third party without the prior consent of Le Colombier Vert. If Le Colombier Vert accepts the transfer of the contract, the client must provide Le Colombier Vert with all information concerning the third party. The transfer must be made at cost price. The transferor and the transferee are jointly and severally liable to Le Colombier Vert for payment of the rental price as well as any additional costs incurred as a result of this transfer.

Article 17 – Insurance:

The client is responsible for all damages caused by their actions. They are required to have holiday insurance to cover these risks. The seller may request proof of insurance.

Article 18 – inventory of fixtures:

Upon your arrival, the concierge service in Yonne will give you a tour of the premises: they will point out the available amenities and provide any necessary instructions. If you notice any malfunction during your stay, you must notify the Yonne concierge service. If you damage anything, you must also report it no later than the time of departure.

The cleanliness of the furnished accommodation upon the tenant's arrival must be noted in the inventory. Cleaning the premises is the responsibility of the vacationer during the rental period. Upon departure, the client must leave the premises in the same clean condition: dishes washed, trash emptied, beds unmade, and sheets folded.

Le Colombier vert is a non-smoking area : please do not smoke or vape inside. Ashtrays are available outside.

Article 19 – Reception of animals:

The furnished tourist accommodation mentioned in the contract does not allow the accommodation of any animals whatsoever.

Article 20 – Disputes:

Any complaint relating to the condition of the premises and the condition of the rental description must be sent to the Conciergerie de l'Yonne within three days of entering the premises.

Article 21 - Force majeure

Force majeure is defined as any event beyond the control of the parties that is both unforeseeable and insurmountable, preventing either the client or the establishment from fulfilling all or part of their contractual obligations. Events of force majeure or fortuitous events are those typically recognized by French courts and tribunals. Neither party shall be liable to the other for any failure to perform its obligations resulting from a force majeure event. It is expressly agreed that force majeure shall suspend the performance of the parties' reciprocal obligations and that each party shall bear its own costs arising therefrom.

Article 22 - Respect for privacy

On each personal data collection form, the customer is informed whether responses are mandatory or optional by the presence of an asterisk. The information processed is intended for Le Colombier Vert and elloha.com, its entities, partners, and service providers (including online payment providers). The customer authorizes Le Colombier Vert and elloha.com to share their personal data with third parties, provided that such sharing is compatible with the performance of the operations incumbent upon Le Colombier Vert and elloha.com.Constellation SAS and Stripe.com, in accordance with these terms and conditions and the Customer Charter for the Protection of Personal Data, will process your payment. Specifically, during online payment, your bank details will be transmitted by the payment provider, stripe.com, to the establishment's bank for the execution of the booking contract. You are informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection as defined by the French Data Protection Act (Loi Informatique et Libertés). However, you consent to this transfer, which is necessary for the execution of your booking. Constellation SAS and Stripe.com, acting in their professional capacity, have committed to the establishment to take all necessary security measures and ensure the confidentiality of data during these data transfers.
