GENERAL CONDITIONS OF SALE - GITE DU COLOMBIER VERT

Article 1: object

These general conditions of sale concern the seasonal rental of the gîte named ""Nid douillet au Colombier vert"".

These general conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by our establishment, the contact details of which are specified in the reservation confirmation document. They govern all the steps necessary for the reservation and the monitoring of the reservation between the contracting parties. The customer acknowledges having read and accepted these general conditions of sale and the conditions of sale of the reserved rate accessible on our reservation platform.These general conditions of sale apply to all reservations made online, via our reservation platform.

Article 2 – length of stay

The signing customer concludes a reservation for a specific period and cannot under any circumstances claim any right to remain in the premises at the end of the stay.

Article 3 – liability

The Révé company, whose commercial name is Le Colombier Vert, manager of furnished tourist accommodation, commissions the Conciergerie de l'Yonne to manage its seasonal rentals. La Conciergerie de l'Yonne is therefore the sole contact for the signing customer and is responsible to him for the execution of the obligations arising from these conditions of sale.The Conciergerie de l'Yonne cannot be held responsible for fortuitous events, force majeure or the actions of any person unrelated to the organization and progress of the stay.

The photographs presented on our reservation platform are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and texts reproduced to illustrate the establishment presented give as accurate an overview as possible of the services offered, variations may occur between the time of reservation and the day of consumption of the service. The establishment cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, due to the third party, due to the client, in particular the unavailability of the internet network, impossibility of access to the website, external intrusion, computer viruses or in the event of prepayment not authorized by the bearer's bank.Any reservation or payment which is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the latter.

The customer accepts and undertakes to respect the Internal Regulations and the clauses detailed below. In the event of non-compliance by the client with one of the provisions of the Internal Regulations, Le Colombier Vert will be obliged to invite the client to leave the establishment without any compensation and or without any reimbursement if a regulation has already been made. been carried out.

Article 4 – reservation and confirmation

The reservation becomes firm when Le Colombier Vert receives the deposit corresponding to 25% of the rent amount to which all additional costs are added. In case of late reservation, the full amount of the reservation is required.

Upon receipt of the costs of the stay, the Conciergerie de l'Yonne will send a confirmation by email to the customer.

The customer chooses the services presented on our reservation platform. He acknowledges having read the nature, destination and reservation methods of the services available on our reservation platform and having requested and obtained necessary and/or additional information to make his reservation with full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability to his needs, such that we cannot be held responsible in this regard. The reservation is deemed accepted by the customer at the end of the reservation process.

Reservations made by the customer are made via the electronic reservation voucher accessible online on our reservation platform. The reservation is deemed to have been made upon receipt of the reservation voucher.

The customer undertakes, prior to any reservation, to complete the information requested on the voucher or reservation request. The customer certifies the veracity and accuracy of the information transmitted. After the final choice of the services to be reserved, the reservation procedure includes entering the bank card in the event of a guarantee or prepayment request, consultation and acceptance of the general conditions of sale and the conditions of sale of the reserved rate. before validation of the reservation and, finally, validation of the reservation by the customer.

Article 5 – absence of withdrawal

The customer is reminded that for reservations made by mail, telephone or internet, the customer does not benefit from the withdrawal period, in accordance with article L121-20-4 of the consumer code relating to accommodation services provided to a specific date.

The conditions of sale of the reserved rate specify the terms of cancellation and/or modification of the reservation.When the conditions of sale of the reserved rate allow it, the cancellation of the reservation can be made directly with the Colombier vert

All reservations are personal and cannot under any circumstances be transferred to a third party, whether free of charge or for a fee.

Article 6 - price

The prices relating to the reservation of services are indicated before and during the reservation. Prices are confirmed to the customer in the amount including tax, in the commercial currency of the establishment, and are only valid for the duration indicated on the reservation platform. If the establishment is debited in a currency other than that confirmed on the reservation, the exchange costs are the responsibility of the customer. All reservations, regardless of their origin, are payable in the local currency of the establishment, unless special arrangements are indicated on site.

Unless otherwise stated on the booking platform, additional services are not included in the price. Taxes (local taxes, tourist taxes, etc.) where applicable, presented on the rates page, must be paid directly to the establishment.

The prices take into account the VAT applicable on the day of the order and any change in the rate applicable to the VAT will be automatically reflected in the prices indicated on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the invoice date.

Article 7 - payments

In the case of a rate subject to online prepayment, the amount paid in advance, referred to as a deposit, is debited at the time of booking.

balance payment:

The customer must pay to Colombier Vert the balance of the agreed service remaining due one month before the start of the stay. The customer who has not paid the balance on the agreed date is considered to have canceled his stay. From then on, the service is once again offered for sale and no refund will be made.

late booking:

If booking less than 30 days before the start of the stay, full payment will be required upon booking.

The green dovecote can send an invoice electronically upon simple request.

The customer communicates his bank details as a guarantee of the reservation except under special conditions or rates, by credit or private bank card (Visa, Mastercard, American Express, Diners Club, etc. depending on the possibilities offered by the establishment's reservation platform ) by directly indicating, in the area provided for this purpose (entry secured by SSL encryption), the card number, without spaces between the numbers, as well as its validity date (it is specified that the bank card used must be valid as of time of consumption of the service) and the visual cryptogram.

He must come to the establishment with the bank card that allowed him to guarantee the reservation.

In the event of a no show (reservation not canceled – customer not present) of a reservation guaranteed by credit card, the establishment will debit the customer, as fixed compensation, of the amount indicated in its general conditions and special conditions of sale.

The establishment has chosen elloha.com/stripe.com to secure online payments by credit card. The validity of the customer's payment card is verified by stripe.com. The payment card may be refused for several reasons: stolen card, blocked card, ceiling reached, entry error, etc. In the event of a problem, the customer must contact their bank on the one hand, or the establishment on the other hand to confirm your reservation and method of payment.

Article 8 - proof convention

Entering the required banking information, as well as acceptance of these general conditions and the voucher or reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized records kept in the computer systems of elloha.com will be kept in reasonable security conditions and considered as proof of communications, orders and payments made between the parties. The customer is informed that his IP address is recorded at the time of booking.

Article 9 – arrival

The Conciergerie de l'Yonne will contact the customer at the latest one week before the start of the stay to set the arrival time together. In the event of a delayed arrival or last minute impediment, the customer must notify the Conciergerie de l'Yonne by telephone or SMS.

Article 10 – cancellation by the customer

Any cancellation must be notified by email, with confirmation of receipt, to the Conciergerie de l'Yonne.

For any cancellation by the customer, reimbursement by Colombier Vert will be made as follows:

  • Cancellation 48 hours after booking: the stay is fully refunded less bank charges if payment by credit card (3%)

  • Cancellation up to the 30th day inclusive before the start of the stay: reimbursement of the stay less bank charges if payment by credit card (3%)

  • Cancellation between the 29th and 8th day before the start of the stay: refund of 50% of the stay less bank charges if payment by credit card (3%)

  • Cancellation between the 7th day and the scheduled arrival day or no-show: no refund will be made.

Article 11 – modification of a substantial element

When, before the scheduled start date of the stay, the Colombier vert finds itself forced to make a modification to one of the essential elements of the contract, the customer may, after having been informed by the Conciergerie de l'Yonne by email , with confirmation of receipt, either terminate the contract and obtain immediate reimbursement of the sums paid without penalty, or accept the modification.

Article 12 – cancellation by the seller:

When, before the start of the stay, Le Colombier Vert cancels the stay, the Conciergerie de l'Yonne must inform the customer by email with confirmation of receipt. The customer will be reimbursed immediately and without penalties for the amounts paid. These provisions do not apply if an amicable agreement has as its object the acceptance by the customer of a substitute stay proposed by the seller.

Article 13 – seller's impediment:

If during the stay, Le Colombier Vert finds itself unable to provide a majority of the services provided for in the contract representing a significant percentage of the price paid by the customer, it will pay the customer compensation corresponding to the proportion of the amount of the rental not consumed.

Article 14 – interruption of stay:

In the event of interruption of stay by the customer, no refund will be made.

Article 15 – reception capacity:

This reservation is established for a maximum capacity of three people. If the number of vacationers exceeds the reception capacity, the Conciergerie de l'Yonne will refuse additional customers. Any modification or termination of contract will then be considered at the customer's initiative.

Parties are prohibited both inside the gîte and outside.

Article 16 – assignment of the contract by the customer:

The customer cannot transfer his reservation to an assignee without the prior agreement of Le Colombier vert. If Le Colombier Vert accepts the assignment of the contract, the customer must provide Le Colombier Vert with all information concerning the assignee. The transfer must be made at cost price. The transferor and the transferee are jointly and severally liable to Colombier vert for payment of the rental price as well as any additional costs incurred by this transfer.

Article 17 – insurance:

The customer is responsible for all damages arising from his fault. It is required to be insured by a resort type insurance contract for these various risks. An insurance certificate may be requested by the seller.

Article 18 – inventory:

On your arrival, the Yonne concierge will show you around the premises: she will mention the facilities available and give all the useful instructions. If, during your stay, you notice a malfunction, you must notify the Conciergerie de L'Yonne. If you damage anything, you must also report this at the latest upon departure.

The state of cleanliness of the furnished accommodation upon the tenant's arrival must be noted in the inventory. Cleaning of the premises is the responsibility of the vacationer during the rental period. When leaving, the customer must leave the premises in the same state of cleanliness: dishes washed, trash cans emptied, beds unmade and sheets folded.

The Colombier Vert gîte is a non-smoking area : please do not smoke or vape inside. There are ashtrays outside.

Article 19 – reception of animals:

The furnished tourist accommodation mentioned in the contract does not provide for the reception of animals , whatever they may be.

Article 20 – disputes:

Any complaint relating to the inventory of the premises and the condition of the rental description must be sent to the Conciergerie de l'Yonne within three days of entering the premises.

Article 21 - Force majeure

Force majeure means any event external to the parties which is both unpredictable and insurmountable and which prevents either the client or the establishment from fulfilling all or part of the obligations provided for in the contract. Force majeure or fortuitous events are those usually recognized by the case law of French Courts and Tribunals.Each party cannot be held responsible towards the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the burden of the resulting costs.

Article 22 - Respect for private life

The customer is informed, on each of the personal data collection forms, of the obligatory or optional nature of the responses by the presence of an asterisk. The information processed is intended for the establishment Le Colombier Vert and elloha.com, its entities, its partners, its service providers (and in particular online payment providers). The customer authorizes Le Colombier Vert and elloha.com to communicate his personal data to third parties on the condition that such communication proves compatible with the carrying out of the operations incumbent upon Le Colombier Vert and elloha.com under these general conditions and in connection with the Customer Charter for the Protection of Personal Data. In particular when paying online, the customer's bank details must be transmitted by the payment provider stripe.com to the establishment's bank, for the execution of the reservation contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate protection of personal data within the meaning of the Data Protection Act. However, the customer consents to this transfer necessary for the execution of his reservation. Constellation SAS / Stripe.com, in their professional capacity, have committed to the establishment to take all security measures and respect data confidentiality for said data transfers.
